Terms and Conditions for TMGCL Ed Services

These terms and conditions apply to the use of the TMGCL Ed website (https://ed.tmgcl.com) and the mobile applications cZeus Launchpad, cZeus Planet, and cZeus School League (collectively "cZeus Apps"), and all related technical services developed or provided by The Mathematical Games Company Limited. TMGCL Ed is a trading name of The Mathematical Games Company Limited, a company registered in England and Wales under company number 8093051, whose registered address is at 1-7 Park Road, Caterham, Surrey, CR3 5TB United Kingdom.

1. Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:

• "Account" means collectively the personal information and credentials used by Users to access TMGCL Ed on-line services.
• "Content" means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of TMGCL Ed on-line services.
• "TMGCL Ed On-line Services" means the services available through the TMGCL Ed website and the cZeus Apps suite.
• "User" / "Users" means any third party that accesses TMGCL Ed on-line services and is not employed by TMGCL Ed.
• "We/Us/Our" means TMGCL Ed.

2. Age Restrictions

By using or registering an account, you represent that (i) you are at least 13 years of age, or (ii) your use has been approved by your parent or legal guardian, or by your school or teacher for school use.

3. Intellectual Property

All Content included in TMGCL Ed on-line services, unless uploaded by Users, is the property of TMGCL Ed, Our affiliates or other relevant third parties. This material is protected by applicable United Kingdom and international intellectual property legislation. You may not reproduce, copy, or distribute material from TMGCL Ed on-line services without express written permission.

4. Use of TMGCL Ed On-line Services

When using TMGCL Ed on-line services, you must adhere to the following rules:

• You must not use obscene or vulgar language.
• You must not submit Content that is unlawful, abusive, threatening, harassing, or otherwise objectionable.
• You must not impersonate other people, particularly employees and representatives of TMGCL Ed.
• You must not use TMGCL Ed on-line services for unauthorized mass-communication such as "spam".

5. Safeguarding and User Interaction

For the safety of our users, particularly within cZeus School League, the following restrictions apply:

• Closed Community: In school-based apps, "Friend Invites" and "Team Invites" are strictly restricted to users within your own verified school community.
• No Chat: There is no text or voice chat facility within the TMGCL Ed environment to eliminate risks of bullying or unauthorized data sharing.
• Public Rankings: Public leaderboards display only chosen nicknames and school names to maintain student anonymity.

6. Accounts and Security

To use certain services, you are required to create an Account. You are responsible for keeping your account information accurate and your password confidential. We accept no liability for losses incurred as a result of your account details being shared by you.

7. Data Protection and Privacy

Use of TMGCL Ed on-line services is also governed by our Privacy Policy. All data is hosted on secure AWS London (EC2) servers within the United Kingdom. We utilize encryption for all stored passwords.

8. Termination

Either TMGCL Ed or you may terminate your Account. TMGCL Ed may terminate your access if we have reason to believe you have breached these terms. Upon termination by TMGCL Ed, any pending orders or payments will be cancelled.

9. Availability and Disclaimers

TMGCL Ed on-line services are provided "as is" and on an "as available" basis. We give no warranty that the services will be free of defects or faults. We accept no liability for any disruption or non-availability resulting from external causes such as ISP equipment failure or legal restrictions.

10. Limitation of Liability

To the maximum extent permitted by law, We accept no liability for any direct or indirect loss or damage arising from the use of TMGCL Ed on-line services. You use these services and their Content at your own risk.

11. Communications

All formal notices shall be given to Us by post to 1-7 Park Road, Caterham, Surrey, CR3 5TB, UK or by email to [email protected]. You may opt out of marketing communications at any time by using the 'Unsubscribe' link in our emails.

12. Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the Law of England and Wales. You agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
